Section 2 — Terms & Conditions of Sale

These terms and conditions apply to all purchases of equipment and training services made through this website or directly with EverSafe Training Ltd. By placing an order or making a booking, you agree to these terms.

2.1 Our Contract With You

A legally binding contract is formed when we confirm your order or booking in writing by email. We reserve the right to decline any order prior to confirmation, in which case any payment taken will be refunded in full.

2.2 Prices and Payment

All prices are displayed exclusive of VAT unless otherwise stated. VAT at the prevailing UK rate will be applied at checkout. We reserve the right to correct any pricing errors prior to order confirmation. Full payment is required at the time of booking or purchase unless a credit account has been agreed in writing.

2.3 Delivery of Equipment

We aim to dispatch stocked items within 3–5 working days. Delivery timescales are estimates and do not form part of the contract. Risk in goods passes to you upon delivery. Title in goods passes to you upon receipt of cleared payment in full.

2.4 Delivery of Training Services

Training courses will be delivered on the date and at the location confirmed in your booking confirmation. Where we are required to reschedule due to circumstances beyond our control, we will provide as much notice as possible and offer an alternative date at no additional cost.

2.5 Liability

EverSafe Training Ltd’s liability to you shall not exceed the total value of the order or booking in question. We do not exclude liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

We are not liable for any indirect or consequential loss, loss of profit, loss of data, or loss of business arising from the use of our products or services.

2.6 Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

These terms comply with the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the Unfair Contract Terms Act 1977, and the Electronic Commerce (EC Directive) Regulations 2002.
